Terms of Service

These terms apply when you visit tbtechsoft.com, submit a contact form, subscribe to our newsletter, or use services provided by Tbtechsoft. By continuing to use the website you agree to them. Where a signed contract exists between us, that contract prevails on any point where the two differ.

1. What we provide

Tbtechsoft provides website design and development, mobile application development, digital marketing, search engine optimisation, hosting management, and digital transformation consulting.

Scope, delivery dates and fees for each project are agreed in a written quotation or contract before work begins. Content on this website is introductory and is not a commitment on price or schedule for any specific project.

2. Using this website

You may view, download and print content on this website for personal use or to evaluate our services. You may not republish it commercially, probe it for vulnerabilities, or send automated traffic at a rate that affects the service for others.

We may suspend access from an address if we detect activity that harms the system or other users.

3. Information you send us

You are responsible for the accuracy of the information you submit through our contact or newsletter forms, and for having the right to provide it.

How we collect, store and use personal data is described separately in our Privacy Policy. You can unsubscribe from the newsletter at any time using the link in the email or by contacting us directly.

4. Quotations, payment and delivery

A quotation is valid for the period stated on it. Payment milestones and acceptance conditions are set out in the contract for each project.

For recurring services such as hosting, domains or maintenance, fees are charged per the agreed billing cycle. We notify you before a renewal falls due; service may be suspended if payment is overdue.

Work is considered delivered once you confirm acceptance, or after the acceptance period stated in the contract passes without a response.

5. Intellectual property

Once payment is complete, you own the source code and content built specifically for your project, within the scope stated in the contract.

Shared components — open-source libraries, frameworks, our internal tooling and our technical know-how — remain with their respective publishers or with Tbtechsoft, and we may continue to use them on other projects.

The Tbtechsoft brand, logo and the marketing content on this website belong to Tbtechsoft. Written permission is required before using them commercially.

6. Warranty and support

We fix technical defects within the delivered scope at no charge during the warranty period stated in the contract.

Not covered: requests that change agreed functionality, incidents caused by third parties (hosting providers, domain registrars, payment gateways, advertising platforms), and incidents caused by changes you make to the source code or configuration yourself.

7. Third-party links and services

This website and the solutions we build may use third-party services such as Google Search Console, Google Analytics, hosting providers or payment gateways.

Those services operate under their own terms. We do not control and are not responsible for third-party content, policies or outages.

8. Limitation of liability

The website is provided as is. We work to keep it available but do not guarantee that it will always be reachable, error-free, or free from interruption caused by maintenance or infrastructure failure.

To the extent permitted by law, Tbtechsoft's liability for a project does not exceed the amount you have paid for that project. We are not liable for indirect losses such as lost revenue, lost business opportunity, or data loss arising from causes outside the agreed scope of work.

9. Changes to these terms

We may update these terms as our services change or as the law changes. The date of the most recent update is always shown at the top of this page.

Changes take effect when published. Where a change materially affects an ongoing contract, we notify the affected client directly.

10. Governing law and contact

These terms are governed by the laws of Vietnam. Disputes will first be addressed through negotiation; failing that, they will be referred to the competent court in Da Nang.
